Terms of Service

You must be at least 18 years old to have an account, buy anything, or sell anything here. You are responsible for your account and for keeping access to your email secure — sign-in links go there.

Supporter accounts are open to anyone. Creator storefronts are by invitation: we add creators from the back end, and only an invited creator can claim a storefront.

Creators set their own membership tiers and product prices. A membership renews on the interval you chose — monthly or yearly — until you cancel it, and cancelling stops future renewals rather than refunding the period you are already in.

Digital products are one-time purchases delivered through secure download links tied to your account. Because digital goods are delivered immediately, purchases are generally final. If something is broken, misdescribed, or never delivered, contact the creator first; if that goes nowhere, contact us and we will step in.

When a creator issues a full product refund, the payment is returned through Stripe and the supporter's download access ends. INDIEARTMARK reverses its application fee on the refunded amount.

Access to gated posts lasts as long as your membership does. If a creator leaves the platform or stops posting, we cannot force them to keep publishing, but we will help you cancel and, where appropriate, refund a renewal you did not get value from.

INDIEARTMARK charges creators a flat 10% of what they earn on the platform. That is our entire business model — no listing fees, no promotion fees, no charge to supporters on top of the price they see.

Stripe separately deducts the processing fees applicable to the connected account and transaction. Those fees go to Stripe, not to us, and are governed by Stripe's current pricing and agreements.

Each creator is the merchant of record for purchases made from that creator. Payments are direct charges on the creator's connected Stripe account. Stripe deducts its applicable processing fees from that account, INDIEARTMARK receives its 10% application fee, and Stripe pays the creator according to the creator's payout schedule. We do not hold creator balances. Verification, payment availability, payouts, disputes, and tax documentation remain subject to Stripe's agreements and requirements.

Creators keep ownership of everything they upload. By publishing here you grant us a limited, non-exclusive licence to host, store, and display that work so the site can function and so we can show previews and thumbnails where you have made them public. That licence ends when you remove the work, except for copies kept in routine backups.

You are responsible for having the rights to what you publish and sell. Do not upload work you did not make or licence, and do not sell someone else's files. We respond to credible copyright complaints and will remove infringing material.

We are a marketplace for artists, and art may address difficult, political, or uncomfortable subjects. That does not override our payment, safety, or content rules. The following content, products, and conduct are prohibited:

• Illegal activity of any kind, including fraud, laundering payments, selling stolen goods or credentials, and any sexual content involving minors — which we report, without exception.
• Unclassified or unsafe adult material. Lawful artistic nudity and mature themes may be hosted only on a correctly labeled 18+ storefront. Public avatars, covers, thumbnails, excerpts, and other previews must remain suitable for general audiences. Sexual services, exploitation, non-consensual intimate material, illegal sexual content, and any sexualized depiction of a minor or apparent minor are prohibited.
• Payment-ineligible adult offerings. The 18+ age gate is a classification system, not commerce approval. Pornography or other mature-audience content designed for sexual gratification, adult services, and anything else prohibited by Stripe may not be sold, commissioned, tipped, or placed behind a paid membership through INDIEARTMARK. We may host lawful artistic material while disabling its payment features.
• Other prohibited commerce. No weapons, controlled substances, gambling, financial services, counterfeit goods, anonymous donations, peer-to-peer money transfers, or payments without an identified product or membership offering.
• Doxxing. Publishing someone's address, phone number, workplace, documents, or other private identifying information — or coordinating others to find it.
• Bullying and harassment. We have an anti-bullying policy and we enforce it. Pile-ons, targeted abuse, stalking a creator or supporter across the site, and threats are all grounds for removal.
• Violent extremism and hate content. Content may not engage in, encourage, promote, praise, or celebrate unlawful violence, violent extremism, or hate speech targeting people based on race, religion, disability, gender, sexual orientation, national origin, or another protected or immutable characteristic.
• Spam and deception. Fake storefronts, impersonating another creator, manipulating payments or reviews, or scraping the site.

Basic etiquette covers the rest: be a person, argue about the work and not the artist, and leave people alone when they ask.

Users can mute, block, and report other accounts. Creators can remove comments from their own discussions and block an account from commenting on or following their storefront. These personal controls do not prevent an administrator from reviewing activity needed to investigate abuse or enforce these terms.

Direct messages may be used for legitimate conversations about memberships, purchases, delivery, and refunds. They are not end-to-end encrypted. Authorized staff may review messages when reasonably necessary for safety, dispute resolution, legal compliance, or policy enforcement. Harassment, spam, concealed prohibited commerce, and attempts to move an ineligible transaction off-platform remain prohibited in messages.

We can remove content, unpublish a product, disable a storefront, or suspend or ban an account that breaks these rules. Suspending a creator makes their products and memberships unavailable for checkout. Stripe may separately pause payments or payouts under its own risk and compliance rules. Serious violations may result in immediate removal without a prior warning.

If you believe an enforcement decision was wrong, reply to the notice and a human will look at it again.

You can close your account at any time. Closing a creator account removes the storefront and its published work from public view; purchase and payout records are retained where we are legally required to keep them. We do not sell your personal data, and we do not run advertising against your work.

The service is provided as-is. We do not guarantee uninterrupted availability, and we are not liable for indirect or consequential losses arising from use of the platform. Nothing here limits liability that cannot be limited by law. Disputes between a supporter and a creator are, in the first instance, between them; we will help where we reasonably can.

We may update these terms as the platform changes. Material changes will be announced on the site before they take effect, and continuing to use INDIEARTMARK after that means you accept the updated terms.
